Palpable

These terms are the agreement between you and Osama Abrar ("we", "us") for the Palpable app on iOS and Android. By downloading or using Palpable, you agree to them. If you don't agree, please don't use the app.
You need to be at least 13 years old. If you're under 18, you need a parent or guardian's permission, and they agree to these terms on your behalf.
Palpable uses Sign in with Apple on iOS and Google Sign-In on Android. You're responsible for keeping access to your Apple ID or Google account secure, and for what happens under your Palpable account. Tell us at osama.0035@gmail.com if you think someone else has got in.
You can delete your account at any time from Settings → Account → Delete Account inside the app.
Palpable offers auto-renewing subscriptions in weekly, monthly and annual lengths. The current price of each plan is always shown in the app — in your local currency, including any applicable tax — before you confirm a purchase, and on the plan's listing in the App Store or Google Play.
All purchases go through Apple or Google, so refunds are handled under Apple's Media Services Terms or Google Play's refund policy — we can't issue them ourselves. If we change the price, we'll tell you in advance and, where the store requires it, the new price only applies after you agree.
Palpable offers affirmations, visualisations, scripting and related practices for personal reflection. It is a self-guidance and wellbeing tool, not a treatment.
If you're struggling with your mental health, please talk to a doctor or a qualified professional. If you're in immediate danger, contact your local emergency services.
The affirmations, scripts and notes you write in Palpable are yours. You keep all rights to them.
You give us a limited licence to store, back up, sync, display and — where you use an AI-powered feature — transmit that content to our AI provider so it can generate a result for you. This licence exists only so we can run the app for you, and it ends when you delete the content or your account. We don't use your content for advertising or to train our own models.
You're responsible for what you write, and you confirm you have the right to write it.
The app itself — its written affirmations, guided material, audio, design, name and logo — belongs to us and is protected by copyright. You get a personal, non-transferable, non-exclusive licence to use Palpable on devices you own or control, as permitted by the usage rules of the store you downloaded it from — Apple's App Store Terms of Service or the Google Play Terms of Service. You may not copy, resell, redistribute or publish our content, or reverse-engineer the app, except where the law says you can regardless.
Some Palpable features generate text using OpenAI. A few things you should know about that:
Don't use Palpable to break the law, infringe anyone's rights, harass anyone, upload malicious code, scrape or bulk-extract our content, interfere with the service, or get around our security or paywall.
We may add, change or remove features, and we may pause the service for maintenance. We'll try to give notice of anything major. If we discontinue Palpable entirely, we'll give you reasonable notice and a way to export your content.
You can stop using Palpable at any time. We may suspend or close your account if you break these terms, if we're required to by law, or if your account is used to harm others. If we close your account without cause, we'll refund the unused portion of your current subscription period where the law requires it.
Palpable is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that it will meet your expectations.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or losses arising from decisions you make in reliance on the app. Our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.
Some places don't allow these limits, so parts of this section may not apply to you. Nothing here limits liability that can't be limited by law — including for death or personal injury caused by negligence, or for fraud. If you're a consumer, your statutory rights are unaffected.
You and we agree, as Apple requires:
These terms are between you and us only — Google is not a party to them and is not responsible for Palpable or its content, and has no obligation to provide support for it. Your download and any purchases are also subject to the Google Play Terms of Service. Where these terms conflict with Google Play's terms in relation to your use of Google Play itself, Google Play's terms prevail.
These terms are governed by the laws of India, and disputes will be subject to the courts of Gorakhpur, Uttar Pradesh — except where consumer law in your own country gives you the right to bring a claim there instead.
We may update these terms. We'll change the date at the top and tell you in the app before anything significant takes effect. Continuing to use Palpable after that means you accept the new terms.
